Problems with global form and Pane splitter

I am trying to wrap the entire page in a form element (specifically for asp.net).

<form>
<a pane/>
<b pane/>
</form>

but what appears to be happening is the javascript repositions these panes in the rendered dom.

<form>
</form>
<a pane/>
<b pane/>

is this normal? Is there anyway I can get my form to encompass the entire body of the page.

This is my temp fix... it is nasty so please feel free to provide a better solution.

At the end of my page I put the following JavaScript

for (var i=0; i < document.body.childNodes.length; i++)
{
//don't move the form... i don't know what it does but it can't be pretty
if (document.body.childNodes[i].id != 'form1')
{
//elements can't be duplicated so by setting the id when we append it the original will be removed
if (document.body.childNodes[i].id == null)
document.body.childNodes[i].id = 'tempID'+i;
document.getElementById('form1').appendChild(document.body.childNodes[i]);
}
}
